Last week, the Supreme Court made a radical decision to require the Biden administration to restart the implementation of the Trump-era policy, Remain in Mexico. 

 

This policy was enacted in 2019, forcing thousands of asylum seekers to be held in rough and horrific conditions while they wait for their claims to be adjudicated. One of Biden’s first actions as president was to formally suspend this policy – and now the Supreme Court and larger right-wing judicial pipeline are trying to force the Biden administration to adopt Trump’s cruel, chaotic, and dehumanizing policies.

This order by the Supreme Court is disturbing and endangers U.S. immigration and border policies. Can you chip in today to help us continue our work to educate and advocate for humane immigration policies?

This kind of ruling exposes the right-wing’s construction of a judicial pipeline to force the Biden administration to adopt Trump policies. This decision defies logic and upends the balance of power between elected branches and the judiciary. 

 

The anti-immigrant judicial pipeline is how we got here. Here’s a breakdown of how it works:

• The state Attorney General is usually the key initiator in these cases, along with fellow GOP AGs
• They select a right-wing federal judge in the state, often a Trump appointee with Federalist Society ties
• Those judges side with the GOP AGs, leading to an appeal to the conservative circuit courts
• This then moves to the now very conservative Supreme Court
